Home | Judicial Review | First Amendment Cases | Other Amendments | US Cases | Recent Case

This case was regarding a man who remained living in California despite executive orders that the government could exclude Japanese American citizens.

In the time of war with Japan, the government issued orders that Japanese Americans could be ordered to vacate areas considered vulnerable to spies. Korematsu didn't leave his home in San Leandro, and the case was brought to the supreme court. The justices decided that the government was within its rights to decide that he may be removed from his home for the safety of the other citizens of the country. Korematsu was removed from the area where he lived with regards to national security.
